2. HIPAA SECTION
Where applicable, PhlebX complies with the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”).
PhlebX implements safeguards designed to protect Protected Health Information (PHI) in accordance with applicable federal and state laws.
SMS communications may contain limited scheduling-related information. Patients should avoid sending sensitive medical information via unsecured text messaging.
For full HIPAA rights regarding access, amendment, or restriction of PHI, patients should contact their ordering provider or health plan.
3. BUSINESS ASSOCIATE DISCLAIMER
PhlebX may act as a Business Associate to certain Covered Entities (including healthcare providers, laboratories, and health plans) as defined under HIPAA.
Where PhlebX functions as a Business Associate:
- Services are provided pursuant to a valid Business Associate Agreement (BAA).
- PHI is used and disclosed only as permitted under the BAA and HIPAA regulations.
- Appropriate administrative, physical, and technical safeguards are implemented in accordance with 45 CFR Parts 160 and 164.
- PHI is not used for independent marketing purposes.
PhlebX does not determine medical necessity, diagnose conditions, or interpret laboratory results. Clinical decisions remain the responsibility of the ordering provider and/or laboratory.
No Independent Covered Entity Relationship
Unless expressly agreed in writing, PhlebX does not act as:
- A Covered Entity
- A treating healthcare provider
- A clinical laboratory performing diagnostic testing
PhlebX’s role is limited to specimen collection and coordination services.
Conflict of Terms
In the event of a conflict between this Policy and an executed Business Associate Agreement, the Business Associate Agreement shall control with respect to PHI governed under HIPAA.
4. SMS TERMS OF SERVICE
4.1 Program Description
By opting into SMS communications from PhlebX, you agree to receive text messages related to:
- Appointment scheduling
- Appointment confirmations and reminders
- Arrival notifications
- Care gap outreach
- Health plan benefit notifications
- Service-related updates
4.2 Message Frequency
Message frequency varies by service needs.
You may receive up to 3–5 messages per scheduling episode, with additional reminders if services remain pending.
4.3 Message & Data Rates
Message and data rates may apply.
Carrier charges are your responsibility.
4.4 Consent to Receive Messages
By providing your mobile number and affirmatively opting in, you consent to receive recurring automated SMS messages from PhlebX.
Consent is not a condition of receiving healthcare services.
